Diversion Model Rules

Diversion-to-Monitoring Rule

The Bellacosa Commission recommended the adoption of a uniform rule by all four departments of the Appellate Division, which would authorize a diversion procedure whereby lawyers who are involved in attorney discipline proceedings may be required to participate in a lawyer assistance program. Proposed Uniform Monitoring Program Guidelines

The Trust has worked with the NY lawyer assistance programs' staff and volunteers to prepare a single set of monititoring program guidelines that go hand-in-hand with the Diversion program, explaining the role of the various players and how they interact.  These guidelines are expected to be acted upon at the November 2006 meeting of the NYSBA Lawyer Assistance Committee.
