Model Law Firm Policy

An important goal of the Policy is to encourage appropriate response to the impairment of any attorney that affects work performance or the quality of services offered to the public.  Its other goals include raising awareness in the practicing bar about solution-oriented responses to the many practitioner crises that arise among its colleagues and the availability of additional resources to address the needs of our profession and the public under these circumstances.  View the Policy

This policy’s goals are

  • To encourage law firms and law departments to recognize impairment issues among legal professionals and to support effective treatment and recovery, thereby insuring delivery of quality legal services and client protection;
  • To encourage impaired attorneys to receive necessary assistance;
  • To encourage use of available resources offered by bar associations

Diversion Model Rules / Department Rules

The Trust recommends the adoption of a uniform rule by all four departments of the Appellate Division, which would authorize a diversion procedure whereby lawyers who are involved in attorney discipline proceedings may be required to participate in a lawyer assistance program.  Click on the listing at the right to see the model rule. The Appellate Division, Second, Third, and Fourth Departments, have amended their court rules to include a diversion process.  See their rules.

Attorney Registration Insert

One of the Trust's early accomplishments was the creation of an Insert, which is now included in the packet of information that the Office of Court Administration mails with attorney registration renewal forms. Over the two-year span for registration, about 180,000 attorneys receive the information. The Insert features a brief evaluation questionnaire and information on lawyer assistance services available throughout the State. View the insert.

Videotape Project

At the time of the Trust's 10th anniversary, remarks were prepared on the history of the lawyer assistance movement in New York and the United States. See video

The LAT produced two brief videotapes on the topic of alcoholism and substance abuse in the profession. Conceived as a method to get the word out on a wide basis to attorneys, the videotapes are meant to be shown in conjunction with CLE events throughout the state. The LAT has made copies available to local and specialty bar associations for this purpose.  Videos are available in 11 minute and 3 minute versions.

Solo/Small Firm Outreach Project

Recognizing that the practitioners in solo and small firm (under 20 members) represent a large portion of attorneys practicing in New York State, the Trust developed a mailing that was sent along with a calendar card to about 40,000 attorneys across the State. The cards contained information on the lawyer assistance programs and committees at the State and local level. The Trust recognizes the cooperation of the New York State Bar Association and the Association of the Bar of the City of New York on this project.
